Navigating product regulations and standards for physical products

A lived experience summary of the regulatory demands, including safety standards, packaging, labelling and compliance considerations across the end-to-end product development lifecycle.
Ensuring compliance with product regulations is crucial when bringing consumer goods to market. Different regions have distinct regulatory requirements, and navigating these can be challenging, especially when developing products across multiple markets.
Throughout my career in product design, development and management, I have worked across a wide range of physical products, including plush toys, apparel, uniforms, stationery, promotional products, packaging, gift-with-purchase activations, consumer electronics and custom-manufactured products.
Across these categories, one lesson remained consistent: Product compliance doesn't begin in the testing laboratory. It begins when the product brief is written.

Understanding Regulatory Product Requirements
Each country has its regulations, primarily designed to benefit its people and achieve government objectives. They mainly cover safety, labelling and environmental compliance. Understanding both global and local regulations is essential when buying, selling, importing, exporting or developing products. It's important to note that International and Local regulations do not supersede one another. In my experience, it is best to satisfy both or whatever is more stringent. In many instances, they are each closely aligned; however, there are nuances for each country or federation—some more than others.
Compliance is part of product development, not a separate activity
In physical product development, compliance sits alongside other commercial and design considerations.
The product team is constantly balancing variables such as:
Customer expectations
Brand positioning
Target market
Product application
Manufacturing capability
Supplier expertise
Materials and components
Cost targets
Packaging requirements
Safety and regulatory obligations
A change in any one of these areas can influence the others.
For example, changing a material may affect testing requirements. Changing a target age group may introduce additional safety considerations. Changing a market may require different labelling, documentation or certification.
This is why experienced product teams consider compliance early. The objective is not simply to pass testing. The objective is to design a product that can be manufactured, sold and supported successfully in its intended market.
Global/International Safety Standards
Understanding what standards actually mean
Standards are frameworks, not universal laws. One of the most common misunderstandings in product development is assuming that international standards are the same as government regulations.
Standards organisations, such as ISO, develop internationally recognised frameworks and technical standards. These standards help organisations, manufacturers and regulators establish consistent approaches to quality, safety, manufacturing and other technical requirements.
However, standards do not automatically replace local laws or regulatory obligations. Each country or region decides which requirements apply within their jurisdiction.
For example, a product may comply with an international standard but still require additional assessment, documentation, labelling or modifications before it can legally be sold in another market.
During product development, it is important to understand the relationship between:
International standards
Regional standards
Government regulations
Industry expectations
Customer or retailer requirements
In practice, product teams often design against the most demanding combination of applicable requirements to create a product suitable for multiple markets.
Examples of various international standards to govern the safety and sustainability of consumer products:
ISO (International Organisation for Standardisation) standards apply to quality and environmental management. ISO standards are globally agreed-upon best practices developed by experts to improve various aspects of business and operations. They provide structured frameworks and requirements that organisations can use to improve processes, manage risk and demonstrate consistency. In a sence they help serve as guidelines for optimal product creation, process management, service delivery, and material sourcing (among others), informed by input from manufacturers, buyers, users, and regulators.
ISO standards cover:
Quality management: Enhancing efficiency and reducing product failures.
Environmental management: Minimising environmental impact and promoting sustainability.
Health and safety: Reducing workplace accidents.
Energy management: Lowering energy consumption.
Food safety: Preventing contamination.
IT security: Securing sensitive information.
These standards help address both well-established needs and emerging global challenges.
ASTM (Advancing Standards, Transforming Markets) International provides over 12,000 standards worldwide and is commonly referenced in the United States.
EN71 is the European toy safety standard, including mechanical, chemical, and flammability safety requirements.
RoHS (Restriction of Hazardous Substances) Directive restricts the use of hazardous substances in electrical and electronic products. It is an EU directive that restricts the use of specific hazardous materials in electronics and electrical products, applicable to products sold in the EU that must meet compliance standards for six restricted substances.

When manufacturing for international markets, ensure your products adhere to the relevant standards to avoid compliance issues. Adhering to standards and selling products internationally requires a significant amount of planning, investigation, and testing. At the very least, it often means additional design considerations for packaging and instructions.
Summary of Australian Product Safety Standards
Australia has stringent consumer protection regulations, and the Australian Competition and Consumer Commission (ACCC) oversees product standards.
Understanding Australian and New Zealand Standards (AS/NZS)
For products developed or sold in Australia and New Zealand, AS/NZS standards are an important reference point.
AS/NZS refers to joint Australian and New Zealand Standards developed through Standards Australia and Standards New Zealand. These technical standards provide guidance and requirements across areas such as product safety, materials, performance, testing methods and manufacturing practices.
They help create consistency across industries and are often referenced by regulators, manufacturers, suppliers and testing laboratories.
However, it is important to understand the relationship between standards and legislation.
An AS/NZS standard is not automatically a law. Some standards are voluntary, while others become mandatory when referenced by Australian legislation or regulations.
In product development, understanding whether a requirement is:
A legal requirement
A recognised industry standard
A customer or retailer expectation
A recommended best practice
It's critical when deciding how a product should be designed, tested and manufactured.
In my experience, many products were developed against a combination of requirements. A product destined for multiple markets may need to satisfy international standards, local regulations, retailer expectations and internal quality requirements simultaneously.
Mandatory vs. Voluntary Standards
Mandatory Standards: Compulsory requirements for certain products to ensure safety and information accuracy before sale. Supplying products in Australia that do not meet these standards is illegal.
Voluntary Standards: Non-compulsory guidelines ensuring product reliability, safety, and performance. While not legally required, the Government can partially or fully adopt these if safety risks exist.
Pro Tip: Many regulations can be interpreted differently. Depending on organisational objectives (cost and market) and product or industry experience, avoid potential risks by implementing and adhering to mandatory standards where-ever possible. It may help create a better quality product with a higher value proposition.
Key Areas for Mandatory Standards Compliance
Safety Standards: To prevent injuries and address risks by setting minimum requirements on performance, materials, design, construction, labelling, and more.
Information Standards: Ensure consumers receive critical information (e.g., ingredient labelling on cosmetics or care instructions for textiles) to make informed purchasing decisions—these commonly impact packaging, labelling, instructions and advertising.
Compliance Requirements
Suppliers, including manufacturers, importers, and retailers, must ensure that their products meet the relevant mandatory standards.
Under Australian law, "Supply" includes any resale, lease, hire, or transfer of goods or services.
Consequences of Non-Compliance
Legal penalties, fines, and business impacts include product recalls, redesign costs, and potential damage to reputation.
Unsafe products risk causing serious injuries or death, particularly among children, resulting in high legal, financial and social costs.
Be sure to understand your obligations, especially when selling in international markets.
Developing New Mandatory Standards
The Australian Government conducts research, market analysis, and consultations before introducing new mandatory standards, taking into account both regulatory and non-regulatory impacts.
Implications for Business and Community
Ensuring product safety avoids legal repercussions, protects public health, reduces healthcare costs, and maintains consumer confidence in the market.

Testing products for compliance with safety standards is essential. This includes checking for choking hazards, sharp edges, strength testing, chemical restrictions and material safety.
However, testing is not simply a final approval step. It is a validation that earlier product decisions have been successful.
Testing requirements vary significantly depending on product category, intended user, materials, construction methods and target market.

Understanding samples, benchmarks and test reports
One of the most important parts of physical product development is understanding that not all samples serve the same purpose.
Throughout development, products move through different stages:
Concept samples: Used to explore design direction and feasibility.
Prototype samples: Used to validate construction, function and appearance.
Bench samples or golden samples: The approved reference sample representing the expected production standard.
Pre-production samples: Final samples produced using the intended manufacturing process before mass production begins.
Production samples: Products produced during manufacturing runs.
For products requiring testing and certification, holding approved reference samples and documentation is an important part of quality management.
A testing report confirms that a specific sample met requirements at the time of testing. The approved benchmark sample provides a physical reference for the expected production standard. Together, they create a clear record of the intended product standard. This becomes particularly important when working with international suppliers.
For global supply chains, the approved sample and test documentation become the reference point when resolving disagreements around quality, specification changes or production variations.
Why holding approved samples matters
Manufacturing changes happen. Sometimes these changes are deliberate. Sometimes they are accidental.
During long production runs or repeat orders, changes can occur because of:
Alternative material suppliers
Manufacturing process changes
Component substitutions
Production staff changes
Human error
Logistics challenges
Cost reduction decisions
Unfortunately, some suppliers may also make unapproved changes to increase their margins. A product may look similar but have differences in material quality, construction, durability or safety. An approved benchmark sample allows product teams to compare production output against the agreed standard.
If a quality issue occurs, the business has evidence to support discussions around corrective action, replacement stock, credit, reimbursement or recall decisions.
Pro Tip: Engage with a local certified testing lab that specialises in your product category to conduct the necessary tests and certifications. This is your best option from a number of standpoints in a business context including risk mitigation. The testing, reporting and certification process will often require "final samples", that you should not expect to be returned.
Throughout my experience, organisations (such as SGS) were frequently used because of their international network, testing capability and experience supporting product testing, factory inspections and production verification across different markets.
Understanding laboratory test reports
A laboratory report is more than a pass or fail result.
A good product manager needs to understand what the report is communicating.
Typical sections include:
Product identification
Sample description
Applicable standards
Test methods used
Test conditions
Individual test results
Non-conformances or failures
Observations and recommendations
One important skill is understanding the difference between:
A failed requirement
A comment or observation
A recommendation
A condition requiring further investigation
Not every note in a report means a product cannot proceed. Equally, not every "pass" means there are no future risks. Experienced product teams review reports carefully, discuss findings with laboratories and suppliers, and determine whether action is required.
Laboratory reports should be reviewed as part of the product decision-making process, not simply filed away as compliance documents

Labelling and Packaging Requirements
Regulations often specify how products should be labelled, including language, font sizes and information that must be displayed, such as:
Age Appropriateness (for toys): Indicate suitable age ranges.
Ingredient and Material Lists: List all ingredients, including allergens.
Safety Warnings: Display relevant warnings, e.g., "small parts - choking hazard."
Country of origin: Certain markets require information about the country where the product was manufactured.
Non-compliant labelling can sometimes result in delays, destruction and/or fines.
Chemical and Material Restrictions
Be aware of restrictions on certain chemicals and materials, such as lead content in paint for toys or preservatives in food. These restrictions vary by market and can impact your choice of materials and production processes.
Environmental considerations
Environmental requirements are becoming an increasing consideration in product development.
This includes material selection, packaging choices, restricted substances and responsible sourcing.
I have worked on projects exploring more sustainable alternatives and supported suppliers through certification processes such as FSC for paper and card packaging.
However, sustainability decisions often involve balancing environmental benefits with manufacturing capability, availability and commercial requirements.
Working with third-party providers and suppliers
As best practice, consider engaging third-party providers to assist with regulatory compliance. These are your best defences in risk mitigation:

Customs Brokers: Help ensure all documentation is correct and expedite the customs clearance process.
Testing and Certification Agencies: Offer product testing and certification services to ensure compliance with safety standards.
Industry Consultants and Associations: Offer timely and up-to-date advice on meeting compliance requirements across various markets and industries.
Associations have numerous added benefits. They can offer product or industry advocacy, professional network development, professional services, and industry events. Associations can also provide wider advice and insight into your market, helping you analyse trends, competitors, opportunities and risks.
Compliance is also supplier management
Due diligence in international manufacturing
When developing products internationally, compliance extends beyond standards and testing.
It also requires confidence in the organisations producing the product.
Third-party services such as factory audits, production inspections and product testing provide additional confidence when working across borders.
I have seen situations where businesses assumed a simple product did not require inspection because the risk appeared low.
One example involved promotional coffee mugs. The business believed the product was straightforward, ordered a full container and paid without arranging any inspection or verification. When the container arrived, it contained second-hand (used) bricks instead of coffee mugs. The supplier had never been independently verified and no pre-shipment inspection had taken place.
The lesson was not about coffee mugs. The lesson was that international trade requires due diligence.
Supplier relationships are built on trust, but good product management also requires verification.
Quality issues are inevitable, but unmanaged risk is not
Good product management reduces the impact of failure
No physical product development process is completely free from defects. Materials vary. Machines wear. Human errors happen. Suppliers make mistakes.
The objective is not to eliminate every possible issue. The objective is to identify risks early, reduce their impact and have processes in place to respond. A well-managed production process means that a quality issue is usually contained through sampling, inspections, testing and corrective action.
A complete production failure is uncommon when appropriate controls are in place.
Establishing a Compliance Framework for Your Business
To streamline the process of regulatory compliance, set up a structured framework within your business- provide the support and resources it needs:
Quality Assurance and Quality Control Quality Assurance prevents issues through systems, specifications and process control.
Quality Control identifies issues through inspections, testing and checks.
Both are required for reliable product delivery.
Internal Compliance Team Establish a team dedicated to monitoring regulations, working with suppliers, and ensuring all products meet necessary standards. This can often be aligned with Q&A and Governance.
Regular Training Train staff on compliance requirements for various products, industries, and markets to minimise non-compliance risk.
Supplier/Vendor Audits Conduct regular audits of your suppliers to ensure they adhere to the necessary quality and safety standards.
Continuous Monitoring Keep track of regulatory changes impacting your products and adjust your compliance processes accordingly.
Case study: a hidden manufacturing risk before production
During the development of a licensed toy product with a promotional metal tin, the product had reached final tooling stages. The tin design had been pressed using a die that was too deep in certain areas. The result was small cracks forming in the metal as it stretched during production.
At first glance, the issue was difficult to identify. The sample appeared acceptable and the defects were small. However, closer inspection showed potential sharp edges developing.
The risk extended beyond product quality. A sharp metal edge on a children's product could create a safety hazard for children, parents, retail staff and anyone handling the product.
The issue was raised before mass production began.
The experience reinforced an important lesson:
Product reviews cannot rely only on specifications and reports. Experienced product people inspect products with a practical understanding of how materials, manufacturing processes and production conditions interact.
Small defects identified early can prevent significant problems later.
Navigating product regulations, whether global or Australian, is a crucial step in ensuring successful development, importation and sale.
By understanding key standards specific to your products, customs processes and compliance strategies, businesses can minimise risks, avoid penalties, and gain a competitive advantage in the marketplace.
In some organisations, quality assurance and compliance teams can be perceived as slowing product development. In my experience, the opposite is true when these teams are involved early. Their role is not to prevent innovation, but to identify risks before they become expensive problems. A balance should be reached between more conservative approaches and delivery aims. Ensure you have an expert in the field advising early on in the ideation and development of the product; this will expedite the process and result in a better product.
